ANIMAL PROTECTION FROM COLOMBIAN CRIMINAL LAW
Abstract
With the issuance of Law 1774 of 2016, in Colombia, the crime that seeks to counteract animal abuse is typified in article 339 A and 339 B of the penal code, which has been called "Crimes against life, physical integrity and emotional of animals”, which has been something new, since its study previously only took place through a constitutional sphere, and with this it initiates an analysis “of the ecological constitution” recognizing that animals have a capacity for perceive sensations and emotions and their incursion with the debate in the cultural field, especially in terms of bullfighting and cockfighting, or from a criminal misdemeanor perspective, now, another sphere of analysis arises that is of equally significant importance , since its study requires a look through the different operators of the ordinary criminal jurisdiction, where we currently find the power of the prosecution as an accuser of displacement Carry out an investigative task that allows accusing and imputing any behavior that has the characteristics of typical, unlawful and guilty related to animal abuse, as well as the different courts and tribunals that have the power to establish a penalty for the same behaviors.
